Resolution authorizing the Mayor and the Director of the Department of Public Works and the Director of the Department Parks and Recreation to enter into an amended Cooperation Agreement with the Pittsburgh Parks Conservancy with the intent of extending and expanding the term and scope of the existing agreement.

WHEREAS, pursuant to Resolution 285 of 1998, the Council of the City of Pittsburgh (“Council”) authorized the City to enter into an agreement with the Pittsburgh Parks Conservancy (“PPC”) in order to utilize the PPC’s fund-raising and planning capabilities for the betterment of the City’s four regional parks: Frick, Schenley, Highland, and Riverview; and
WHEREAS, the City and PPC entered into this agreement (“Agreement”) on April 10th, 2000 for a term not-to-exceed ten years; and
WHEREAS, pursuant to Resolution 364 of 2011, Council authorized the City to 1. expand the Agreement to permit work in additional parks designated by the City and 2. extend the Agreement for an additional term of ten years with an automatic annual extension occurring thereafter unless otherwise terminated by the parties; and
WHEREAS, the City and PPC accordingly renewed and amended the Agreement on December 12, 2011; and
WHEREAS, the City and PPC now wish to further amend and extend the Agreement to encourage and support the PPC in their desire to work in the entire park system, especially in areas where there has not historically been a presence, as designated by the City; and
WHEREAS, it is the mutual intent of the City and the PPC to embrace equitable investment and consider to the Restoring Pittsburgh Parks plan and other documents and methodologies that support long term strategic equitable investment in Pittsburgh’s park system
WHEREAS, the City wishes to invite the PPC to informally participate in the City’s prescribed budget process, beginning May 15th through annually inviting PPC to submit their suggested budget priorities for the following year and reporting from previous calendar year PPC’s completed work, MDBE participation, local business participation, and workforce development; and
WHEREAS, the City and PPC wish to recommit to their partnering on City park projects on a project-by-project basis to be now performed equitably across the City’s entire park system.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Public Works, and the Director of the Department of Parks and Recreation, are authorized to further amend the April 10, 2000 agreement with the Pittsburgh Parks Conservancy, as amended on December 12, 2011, in order to:
1. Renew the term for an additional ten years,
2. Expand the Cooperation Agreement scope from the City’s regional parks to the City’s entire park system,
3. Invite PPC to submit an annual report to City Council detailing budget priorities, completed work, MDBE participation, local participation, and workforce development, and
4. Recommit to partnering on City park projects on a project-by-project basis.
5. Final agreement shall be approved by City Council and submitted to the City Clerk to be read and filed.
6. Any amendments to the agreement shall be approved by City Council.
Section 2. Said Agreement or Agreements shall be approved by the City Solicitor as to form.
