Ordinance amending and supplementing the Pittsburgh City Code, Title Five: Traffic, Article VII: Parking, Chapter 541: General Parking Regulations, Section 541.02: Prohibitions in Specified Places.

 

Body

The Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.                     Pittsburgh City Code, Title Five: Traffic, Article VII: Parking, Chapter 541: General Parking Regulations, Section 541.02: Prohibitions in Specified Places. is hereby amended and supplemented as follows:

 

§ 541.02 - PROHIBITIONS IN SPECIFIED PLACES.

Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle or in compliance with law or the directions of a police officer or official traffic control device, no operator of a vehicle shall, and no owner of a vehicle shall allow the vehicle to:

A)                     Stop, stand or park a vehicle:

1)                     On the roadway side of any vehicle stopped or parked at the edge or curb of a street except that a pedalcycle may be parked as provided in Vehicle Code 3509(b)(2).

2)                     On a sidewalk except that a pedalcycle may be parked as provided in Vehicle Code 3509(b)(2).

3)                     Within an intersection.

4)                     On a crosswalk.

5)                     Between a safety zone and the adjacent curb within thirty (30) feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by official traffic control devices.

6)                     Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.

7)                     Upon any bridge or other elevated structure upon a street or within a street tunnel.

8)                     On any railroad tracks.

9)                     In the area between roadways of a divided street, including crossovers.

10)                     At any place where official signs prohibit stopping.

11)                     In a restricted time parking zone during the posted prohibited times.

12)                     Within fifteen (15) feet of a transit stop sign.

13)                     Other than a taxicab in a taxicab stand.

14)                     To make repairs except in an emergency.

15)                     In a bicycle lane. A bicycle lane is defined as a portion of the roadway that has been designated by striping, signage, and pavement markings for the preferential or exclusive use of bicyclists.

a)                     A Paratransit vehicle, or motor vehicle with a disability license plate or placard, that is picking up or dropping of a person(s) with a disability are exempt. A driver of any vehicle transporting a person with a disability, which is picking up or dropping off that person(s), is exempt. Such stopping shall be limited to the time necessary to complete drop-off and/or pick-up a of a person with a disability. The driver must yield to bicyclists before entering the bicycle lane. The driver must remain in sight of the vehicle at all times while assisting a passenger. A driver of any vehicle transporting a person with a disability may stop a vehicle in a bicycle lane for pick-ups and/or drop-offs upon passenger request at the curb and only if there are no other safe and accessible options for doing so. The driver shall put the vehicle flashers on and be in sight of the vehicle at all times during the pick-up and/or drop-off. Once the passenger has been picked up or dropped off, the vehicle must immediately vacate the bicycle lane.

b)                     The Director of the Department of Mobility and Infrastructure may grant special parking exceptions where appropriate. Exceptions must be demarcated by signage.

B)                     Stand or park a vehicle:

1)                     In front of a public or private driveway or within three (3) feet thereof.

2)                     Within fifteen (15) feet of a fire hydrant.

3)                     Within twenty (20) feet of a crosswalk at an intersection.

4)                     Within thirty (30) feet upon the approach to any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway.

5)                     Within twenty (20) feet of the driveway entrance to any fire station or, when properly sign posted, on the side of a street opposite the entrance to any fire station within seventy-five (75) feet of the entrance.

6)                     Where the vehicle would prevent the free movement of a public transit vehicle.

7)                     On a limited access highway unless authorized by official traffic control devices.

8)                     At any place where official signs prohibit standing.

C)                     Park a vehicle:

1)                     Within fifty (50) feet of the nearest rail of a railroad crossing.

2)                     At any school where official signs prohibit parking.

3)                     Overtime in a limited time parking zone.

4)                     In a no parking street cleaning zone if (1) the street cleaning actually occurs that day and (2) the violation occurs before the street cleaning takes place.

5)                     In a no parking zone.

6)                     If displayed for sale on any street.

7)                     For longer than thirty (30) minutes in a loading zone.

8)                     In front of an entrance to a residence in such a manner as to limit or completely block ingress and egress to said residence.
