Title
Resolution authorizing the Director of the Department of Finance to enter into a License Agreement with Module Design, Inc. and ECS Mid-Atlantic, LLC, to allow the performance of pre-development geotechnical survey work on designated City property in order to facilitate the construction of a ten-unit mixed-income housing development project.

Body
WHEREAS, the City is currently the owner of certain real estate designated as the 5100 Block of Rosetta Street, Pittsburgh, PA 15206, Lots 50-G-60, 50-G-62, 50-G-63, 50-G-65, 50-G-66, 50-G-68, 50-G-69, 50-G-70, and 50-G-72 (collectively, the "Project Site"); and

WHEREAS, Module Design, Inc. ("Module") plans to construct a ten-unit mixed-income housing development project on the Project Site (the "Project"); and

WHEREAS, City Council has previously authorized the City to transfer the Project Site parcels to the Urban Redevelopment Authority of Pittsburgh (the "URA") for subsequent transfer to Module; and

WHEREAS, the City is in the process of effecting these transfers to the URA; and

WHEREAS, in order to ensure the Project meets its schedule, geotechnical surveys, including soil borings and water infiltration tests, are required to be performed on the Project Site in order to begin preparing for construction of the Project, and Module has requested a license to allow its engineer, ECS Mid-Atlantic, Inc., to access the Project Site to perform such geotechnical survey work;

WHEREAS, in order to facilitate the Project, the City is willing to provide a license to access the Project Site to ECS, subject to the terms and conditions set forth in the License Agreement; and

WHEREAS, there will be no cost to the City in conjunction with ECS's access or use.
