Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Office of Management and Budget, on behalf of the City of Pittsburgh, are hereby authorized to enter into an Agreement or Agreements with the Pittsburgh Water and Sewer Authority ("PWSA") for the completion of lead line replacement projects, as approved in the City of Pittsburgh's American Rescue Plan, at a cost not to exceed Seventeen Million Five Hundred Thousand Dollars ($17,500,000).

Funds to the PWSA shall be paid from the American Rescue Plan Trust Fund, JDE account 0222905500.53901.00.

Section 2. The City of Pittsburgh reserves the right to re-appropriate funds from said Agreement or Agreements.

Section 3. Said Agreement or Agreements shall include terms indicating that the PWSA will follow all rules and compliance guidelines and will be held financially responsible for any unauthorized spending.

Section 4. Per U.S. Department of Treasury guidance, all funds must be obligated by December 31, 2024 and spent by December 31, 2026.

Section 5. Said Agreement or Agreements shall be approved by the City Solicitor as to form.

Section 6. The Pittsburgh City Controller is authorized to perform an audit of said Agreement or Agreements, which shall include an accounting of all monetary exchanges and any other interactions between the two entities and any potential sub recipients.
