Resolution amending Resolution number 721 of 2019, entitled “Resolution authorizing the Mayor and the Directors of the Department of Parks and the Department of Public Works to enter into a Lease Agreement with the Pittsburgh Ballet Theater for a portion of real property located on Liberty Avenue between 29th and 30th Streets” to include the proposed Lease for approval by a majority vote of City Council before final execution between the Mayor and the Directors of the Department of Parks & Recreation and the Department of Public Works and the Pittsburgh Ballet Theater, as required by the original 2019 Resolution.

WHEREAS, in 1995 and in 2010 the City entered into fifteen (15) year Lease Agreements with the Pittsburgh Ballet Theater (“PBT”) for the area commonly referred to as Denny Park; and

 

WHEREAS, under the terms of those Lease Agreements, the PBT agreed to renovate and maintain the park in exchange for the ability to use parking spaces along with park patrons; and

 

WHEREAS, the parties now wish to enter into a new Lease Agreement for the same purposes.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Directors of the Department of Parks & Recreation and the Department of and Public Works are authorized to propose enter into a Lease Agreement with the Pittsburgh Ballet Theater for a portion of real property located on Liberty Avenue between 29th and 30th Streets in the Sixth Ward, Pittsburgh, Allegheny County, Pennsylvania, known as Denny Park.

 

Section 2.                     The Lease Agreement will be for a term no longer than twenty-nine (29) years and in consideration therefore, the Pittsburgh Ballet Theater will maintain the entire grounds known as Denny Park, other than a defined area containing a play structure, which will be licensed back to the City of Pittsburgh.

 

Section 3.                     The proposed Lease attached hereto as Exhibit A, which responds to concerns raised by the Community and which is subject to City Council approval pursuant to Resolution number 721 of 2019, must be is hereby approved by a majority vote of City Council before final execution and may be executed between by the Mayor and the Directors of the Department of Parks & Recreation and the Department of Public Works and the Pittsburgh Ballet Theater.

 

Section 4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
