Resolution authorizing the Director of the Department of Finance to enter into a Right of Entry Agreement with Urban Redevelopment Authority of the City of Pittsburgh and City Source Associates to allow the removal of a tree located on designated City property.

WHEREAS, the Urban Redevelopment Authority of the City of Pittsburgh (the “URA”) is conservator of certain property located at 400 Larimer Avenue, Pittsburgh, PA 15206 (the “URA Property”) on which a structure is located; and

 

WHEREAS, the City owns a parcel that neighbors the URA Property, Block 124-N, Lot 223, 402 Larimer Ave., Pittsburgh, Pennsylvania 15206, (the “City Property”); and

 

WHEREAS, the URA has identified a tree located on the City Property that the URA believes could affect the structure located on the URA Property, and the URA has requested that City Source Associates (“CSA”) be provided access to the City Property to allow CSA to remove the tree; and

 

WHEREAS, CSA has agreed to use due care in maintaining the natural state of the City Property insofar as is possible during and after their requested entry; and

 

WHEREAS, the City has agreed to allow CSA to come upon its property to facilitate the tree removal; and

 

WHEREAS, there will be no cost to the City in conjunction with CSA’s access or use.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Director of the Department of Finance is hereby authorized to enter into a Right of Entry Agreement for the City Property with the URA and CSA in order for CSA to remove a tree located on the City Property.  CSA shall complete all project work authorized under the Right of Entry at no cost to the City.  The Right of Entry shall be approved as to form by the City Solicitor.
