Ordinance authorizing the City of Pittsburgh (“City”) to enter into an Intergovernmental Cooperation Agreement with the Borough of Wilkinsburg (“Borough”) for providing fire and emergency management services to the Borough pursuant to the General Local Government Code, 53 Pa. C.S. §§2301 et seq., and the Emergency Management Services Code, 35 Pa. C.S. §§7501 et seq.

WHEREAS, the City and Borough previously entered into Intergovernmental Cooperation Agreements with the Borough of Wilkinsburg with regard to fire and emergency management services in 2011 and 2016; and,

 

WHEREAS, the prior Intergovernmental Cooperation Agreement between the City and Borough expired December 31, 2020; and,

 

WHEREAS, the City and Borough seek to continue their cooperative arrangement by entering into a new Intergovernmental Cooperation Agreement or Agreements with regard to fire and emergency management services for a three-year term commencing on January 1, 2021 and expiring December 31, 2023; and,

 

 

Be it resolved by the Council of the City of Pittsburgh hereby enacts as follows:

 

SECTION 1 - CONDITIONS OF AGREEMENT

The City will provide the Borough with respect to fire protection services and emergency management services pursuant to the pursuant to the General Local Government Code, 53 Pa. C.S. §§2301 et seq., and the Emergency Management Services Code, 35 Pa. C.S. §§7501 et seq. The parties' joint disaster emergency management plan will, pursuant to 35 Pa. C.S. §7503(1), serve as the disaster emergency management plan for both the City and the Borough. 

The cost of such Agreement(s) is predicated on wages and benefits currently provided under the current labor agreement between the City and its firefighters’ union (i.e. IAFF Local 1). To the extent any future labor agreements between City and the Union provide for an increase in wages or benefits to members of the Union, the Agreement(s) shall be increased accordingly subject to required approval of the Council of the City of Pittsburgh.

 

SECTION 2 - DURATION OF AGREEMENT

Said Agreement or Agreements shall be for a term of three years, commencing on January 1, 2021 and expiring December 31, 2023.

 

SECTION 3 - PURPOSE AND OBJECTIVES

Pursuant to 53 P.S. §2305 and 35 Pa. C.S. §7503, the City of Pittsburgh hereby resolves to enter into an Intergovernmental Cooperation Agreement or Agreements with the Borough of Wilkinsburg for providing fire protection services and emergency management services thereto.

 

SECTION 4 - FINANCING

Pursuant to 53 P.S. §2307(4), and in consideration of the services that must be financed pursuant to this Agreement, the Borough shall pay the City a fixed amount on a quarterly basis per the schedule attached to the parties’ Intergovernmental Cooperation Agreement in an amount not to exceed SIX MILLION TWO HUNDRED FIVE THOUSAND FOUR HUNDRED SEVENTY-EIGHT DOLLARS AND EIGHTY-EIGHT CENTS ($6,205,478.88). Revenue to the City will be posted to JDE Account 11101.250000.43.43157 according to the following schedule:

 

2021               $1,997,755.76

 

2022               $2,067,677.20

 

2023               $2,140,045.92

 

TOTAL:         $6,205,478,88

 

SECTION 5 - ORGANIZATIONAL STRUCTURE

Services provided by the City as authorized hereunder are organized under its Department of Public Safety and Bureau of Fire.

 

SECTION 6 - REAL/PERSONAL PROPERTY

All property involved in the performance of said Agreement(s) is owned by the City of Pittsburgh.

 

SECTION 7 - GROUP INSURANCE/EMPLOYEE BENEFITS

Pursuant to 53 P.S. §2307(7), to the extent any entity is created hereunder it shall be empowered to enter into contracts for policies of group insurance and employee benefits, including Social Security, for its employees.

 

SECTION 8 - MISCELLANEOUS

All resolutions and ordinances or portions thereof that are inconsistent herewith are hereby repealed to the extent of such inconsistency.

A copy of this Ordinance shall be filed with the Allegheny County Department of Emergency Services and shall remain in effect unless amended. Any amendments hereto shall also be filed with the Allegheny County Emergency Management Coordinator.

Said Intergovernmental Cooperation Agreement(s) shall be in a form approved by the City Solicitor.
