Title
Resolution authorizing the Mayor to execute an Administrative Order on Consent with the Pittsburgh Water and Sewer Authority and the U.S. Environmental Protection Agency in order to implement requirements associated with a NPDES Stormwater Permit.

Body
WHEREAS, Section 301(a) of the Clean Water Act, 33 U.S.C. ?1311(a), prohibits discharge of any pollutant (with stated exceptions) from a point source into waters of the United States except in compliance with a permit issued pursuant to the National Pollutant Discharge Elimination System ("NPDES") program; and

WHEREAS, the EPA has authorized the Pennsylvania Department of Environmental Protection ("PA DEP") to issue NPDES permits in the Commonwealth of Pennsylvania; and

WHEREAS, the City and PWSA are deemed to own and operate a small "municipal separate storm sewer system" or "MS4" in the City of Pittsburgh, Allegheny County, Pennsylvania; and

WHEREAS, PA DEP issued the City and PWSA NPDES Permit No. PAI136133 for stormwater discharges from a regulated small MS4 in 2004, and the PA DEP thereafter administratively extended the 2004 permit through June 30, 2020; and

WHEREAS, subsequently, the PA DEP issued the City and PWSA a new NPDES Permit No. PAI136133 to authorize the discharge stormwater from a regulated small MS4, effective July 1, 2020 with an expiration date of June 30, 2025; and

WHEREAS, the City and PWSA are working cooperatively and with a consultant to ensure that all outstanding responsibilities and obligations required under the current NPDES permit are met in a timely manner; and

WHEREAS, the U.S. Environmental Protection Agency ("EPA") has performed an assessment to evaluate whether all NPDES permit requirements have been implemented and finds it necessary to further define the City's and PWSA's intentions with respect to outstanding responsibilities and obligations under the current NPDES permit.
