Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Mobility and Infrastructure are authorized to enter into an agreement with Bakery Square 2 Office Holdings Parcel A, L.P., a Pennsylvania limited partnership (hereinafter, the "Grantor"), having an address at 712 Main Street, Suite 2500, Houston, Texas 77002 for the purposes of granting a perpetual, exclusive easement solely for the purpose installing and maintaining Signal Equipment on the properties

 

WHEREAS, Grantor is the fee owner of certain land located in the City of Pittsburgh, County of Allegheny, Pennsylvania, designated as Lot and Block 84-M216,

 

WHEREAS, the Property will hold within its boundaries and outside of the public right-of -way a certain traffic signal,

 

WHEREAS, Grantor wishes to provide necessary access to the City of Pittsburgh for Grantee to maintain the Signal consistent with maintenance it would otherwise receive within the public right-of-way; and

 

WHEREAS, Grantor is willing to grant to Grantee an easement for this maintenance and other purposes described herein over such portion of the Property.
