And, further authorizing the expenditure of funds for the purchase, closing, and other associated auxiliary costs not to exceed Ten Thousand Dollars ($10,000).   And, further authorizing acceptance of that lot and dedicating that lot and an adjacent City-owned lot, together, as the Nelson Mandela Peace Park.

WHEREAS, the City, the Bloomfield-Garfield Corporation, and Garfield residents wish to expand the Nelson Mandela Peace Park and add green space for community recreation and enjoyment; and,

 

WHEREAS, in lieu of taking by eminent domain, the City seeks to purchase 5164 Broad Street, which is adjacent to the Nelson Mandela Peace Park, thus expanding that Park in accordance with the desires of the Garfield community and the City.

 

WHEREAS, the Bloomfield-Garfield Corporation, which owns 5164 Broad Street, has agreed to sell the property to the City for this purpose; and

 

WHEREAS, the City wishes to enter into an agreement with the Bloomfield-Garfield Corporation in order to acquire that property.

 

WHEREAS, the City wishes to accept Block and Lot Number 50-L-188 and then to dedicate both Block and Lot Number 50-L-188 and Lot and Block 50-L-189 together as the “Nelson Mandela Peace Park.”

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Directors of the Departments of Finance, City Planning, and Public Works on behalf of the City of Pittsburgh, are authorized to execute an Agreement of Sale and all related documents necessary to effect the purchase by the City, in lieu of taking by eminent domain, of 5164 Broad Street in the 10th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, identified as Block and Lot Number 50-L-188; with the owner Bloomfield-Garfield Corporation, and to accept a deed for the property. All documents must be approved as to form by the City Solicitor.

 

The purchase price, as stipulated in that Agreement of Sale, closing costs, and other associated costs (collectively the “Acquisition Costs”) will not exceed ten thousand dollars ($10,000). Monies allocated for the Acquisition Costs will be payable as follows: 

Funding for that agreement will be authorized for appropriation from the following code account:

Section 2.                     The dedication of the Block and Lot Number 50-L-188 is hereby accepted, and once purchased, both Block and Lot Number 50-L-188 (5164 Broad Street) and Lot and Block 50-L-189 together will be hereby dedicated as the “Nelson Mandela Peace Park.”
