Resolution authorizing acceptance by the City of Pittsburgh of the dedication of certain property in the Smallman Street project in the 2nd Ward, 7th Council District of the City of Pittsburgh for public highway purposes, and further accepting any grading, paving, lighting, curbing, traffic signals, street trees and public utilities located therein and fixing the width and position of the roadway and sidewalk thereof.

WHEREAS, as part of the continuing development of the Produce Terminal site (the “Site”), the Urban Redevelopment Authority of Pittsburgh, owner of certain property in the Smallman Street project in the 2nd Ward, 7th Council District of the City of Pittsburgh, wishes to dedicate certain streets to the City of Pittsburgh for public highway purposes (“the Dedication”); and

 

WHEREAS, the Dedication is available to the City in conjunction with and as a result of City’s willingness to subsequently vacate certain space within the dedicated area to Smallman Holdings, LLC, the developer of the Site; and

 

WHEREAS, the City of Pittsburgh wishes to accept the Dedication in furtherance of the development of the Site and in consideration for City’s subsequent vacation of a portion of the Dedication.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Mobility and Infrastructure are authorized, on behalf of the City of Pittsburgh are authorized to take all steps necessary to accept the dedication of the following parcel is hereby accepted for public right of way purposes:

 

Parcel A (Smallman Street):

 

All that certain tract of ground situate in the Second (2nd) Ward, City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania being an additional variable width right of way to be dedicated for Smallman Street (existing 60 foot right of way), being Parcel “A” in the Smallman Street Plan of Lots as recorded in Plan Book Volume 300, page 43, being more particularly described to wit:

 

Parcel A (Smallman Street):

 

Beginning at a point at an intersection of the northerly right of way line of Smallman Street and easterly right of way line of 16th Street thence along 16th Street right of way line North 42°09'09" West a distance of 24.53 feet to a point, thence along Parcel 1 of said plan North 50°45'36" East a distance of 804.64 feet to a point, thence North 47°56'21" East a distance of 477.45 feet to a point, thence North 43°57'24" East a distance of 261.81 feet to a point on 21st Street westerly right of way line, thence along said right of way line South 42°40'39" East a distance of 22.84 feet to a point on Smallman Street right of way line, thence along the existing northerly right of way line of Smallman Street South 39°02'44" West a distance of 128.33 feet to a point, thence South 47°56'21" West a distance of 612.69 feet to a point, thence South 50°45'36" West a distance of 804.00 feet to the POINT OF BEGINNING.

 

The above described parcel contains 0.894 acres (38934 sq. ft.)

 

Section 2.                     The dedication shall include the grading, paving, curbing, traffic signals and lighting of the parcel described above as public improvements of the City of Pittsburgh.
