Title
Resolution authorizing the Mayor and the Directors of the Department of Mobility and Infrastructure and Department of Finance, on behalf of the City of Pittsburgh, to execute a Declaration of Restrictions and Covenants over certain City parcels as a condition of a grant for four hundred eight thousand, nine hundred dollars ($408,900) provided by the Allegheny County Sanity Authority Green Revitalization of Our Waterways program for certain green infrastructure elements of the I-579 CAP Project.

Body
WHEREAS, the City of Pittsburgh owns certain land containing +/- 3.5 acres, currently identified by the Allegheny County Department of Real Estate as Block and Lot No. 2-B-107, 2-B-257, 2-B-402, being more particularly described in that certain Deed recorded at Deed Book Volume 17329, Page 312, and Volume 16076, Page 82, together with the portion of 2-B-400 that is identified as Parcel Open Space "H" in the Lower Hill Planned Development District Plan No. 2 as recorded on January 19, 2019 in the Allegheny County Department of Real Estate at Plan book Volume 295, Page 101 (collectively "the Property); and

WHEREAS, certain green infrastructure will be constructed on the Property as part of the I-579 Cap project, to be funded in part by of a grant for four hundred eight thousand, nine hundred dollars ($408,900) from the Allegheny County Sanity Authority ("ALCOSAN") Green Revitalization of Our Waterway's ("GROW") program; and

WHEREAS, the GROW grant requires in part that the City of Pittsburgh must execute a Declaration of Covenants to provide access, operation and maintenance to the proposed green infrastructure; and

WHEREAS, the City of Pittsburgh wishes to now file a Declaration of Restrictions and Covenants over the Property; therefore

Be it resolved by the Council of the City of Pittsburgh as follows:
