Title
Resolution amending Resolution No. 438 of 2018 to extend the proposed term duration of a new Lease Agreement between the City of Pittsburgh and Phipps Conservatory and Botanical Garden for the Scaife Garage and Garden Center Facility.

Body
WHEREAS, pursuant to Resolution No. 438 of 2018, effective June 14, 2018, City Council authorized the Mayor and the Director of the Department of Public Works to enter into a new Lease Agreement(s) with the Phipps Conservatory and Botanical for the lease of the Scaife Garage located on Mellon Park Road adjacent to the public parking lot and the Garden Center Facility for an annual rental fee of One Dollar ($1.00) per year until May 31, 2031, with the possibility of renewal, with the right to use that facility as an integral part of the Garden Center renovation project; and

WHEREAS, the parties had actually agreed for the proposed duration of the term to extend through October 31, 2047; and

WHEREAS, the parties now wish to formally extend the potential duration of the term in the Lease Agreement(s).


Now therefore, be it resolved by the Council of the City of Pittsburgh as follows:

Section 1: Section 1 of Resolution No. 438 is hereby amended to read:

The Mayor and the Director of Public Works, on behalf of the City of Pittsburgh are hereby authorized to enter into a Lease Agreement(s) with the Phipps Conservatory and Botanical Garden for the lease of the Scaife Garage located on Mellon Park Road (adjacent to the parking lot) and the Garden Center Facility for an annual rental fee of One Dollar ($1.00) per year until October 31, 2047, with the possibility of renewal, subject to terms set forth therein. The Lease Agreement(s) shall include the right to use the Garden Center Facility as an integral part of the Garden Center renovation project.
