Resolution authorizing the Mayor and the Director of the Department of City Planning to enter into a Second Amendment to the Cooperation Agreement for Program Administration Assistance with the Pittsburgh Downtown Partnership regarding its offer to provide administrative assistance to the City for The Market Square Public Art Program and to enter into an Art Exhibition Loan Agreement and License with Alisha B. Wormsley and Ricardo Iamuuri Robinson and the Pittsburgh Downtown Partnership for the loan of “Ascension” for the Program’s 2019 display.

                     WHEREAS, the City, through the Department of City Planning, established the Market Square Public Art Program (the “Program”) in which qualified artists are selected to loan artwork to the City for temporary placement in Market Square; and

 

                     WHEREAS, the Program functions to supplement the lack of regular outdoor late winter/early spring programming in Market Square; and

 

                     WHEREAS, the Program enables the City to build on its reputation as a strong and innovative arts community and to leverage public art as a way to make Market Square a vibrant and safe year-round attraction and destination for residents and visitors; and

 

                     WHEREAS, in creating this Program, the City sites existing works or commissions art installations specifically intended for temporary placement in historic Market Square and will retain final authority for curating the Program; and

 

                     WHEREAS, in order to further its mission of promoting innovative programs that enhance the Downtown neighborhood, the Pittsburgh Downtown Partnership (“PDP”) has generously assisted the City with the Program by administering certain Program components, including fundraising for the proposed art installations and payment to Artists; and

 

                     WHEREAS, the parties originally entered into a Cooperation Agreement for Program Administrative Assistance in 2013 and entered into a First Amendment to the Cooperation Agreement in 2015 to extend the PDP’s assistance for the Program through the beginning of 2019 and to provide funding for the 2015 and 2016 exhibitions; and

                     

                     WHEREAS, the parties now wish to enter into a Second Amendment to the Cooperation Agreement to extend the term of the Cooperation Agreement for one additional season to last through May 14, 2019 with no additional costs to the City.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of City Planning are authorized to enter into a Second Amendment to Cooperation Agreement for Program Administration Assistance with the PDP regarding its offer to provide administrative assistance to the City for The Market Square Public Art Program. The Second Amendment to the Cooperation Agreement shall encumber and include no additional City funds and shall run through May 14, 2019. The Second Amendment to the Cooperation Agreement shall be approved by the City Solicitor as to form. 

 

Section 2.                     The Mayor and the Director of the Department of City Planning are further authorized to enter into an Art Exhibition Loan Agreement and License with Alisha B. Wormsley and Ricardo Iamuuri Robinson (the “Artists”) and the PDP in order to allow for the loan and display of “Ascension” for the City’s Market Square Public Art Program in 2019.  All funding for payment to the Artists due under the Art Exhibition Loan Agreement and License will be the sole responsibility of the PDP. The Art Exhibition Loan Agreement and License shall be approved by the City Solicitor as to form.
