Resolution authorizing the Mayor and/or the Director of the Department of Mobility and Infrastructure and/or the Director of the Department of Finance, on behalf of the City of Pittsburgh, to enter into all necessary Agreements to acquire and secure a right-of-way and temporary construction easements, as-needed, to advance certain remediation work in or around Streets Run.

WHEREAS, the City wishes to complete certain remediation work in or around Streets Run; and,
WHEREAS, the City requires certain property rights in order access the construction area and must have clear right-of-way for the project; and,
WHEREAS, the City wishes to enter into agreements with certain property owners to acquire the necessary right-of-way and other property rights; and,
WHEREAS, the City will determine whether to engage in a taking of the property or discontinue the project if such property owners do not wish to convey their property.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and/or the Director of the Department of Mobility and Infrastructure and/or the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to enter into Agreements with multiple landowners, in lieu of eminent domain, as necessary to secure the right-of-way and temporary construction easements for certain remediation work in the vicinity of Streets Run.
Section 2. The areas and easements necessary for right-of-way and authorized for acquisition are depicted in further detail in the attached construction plan.
