Resolution providing for the acceptance and acquisition in lieu of eminent domain by the City of Pittsburgh from the Sports & Exhibition Authority of Pittsburgh and Allegheny County of its rights, title and interest in and to certain property in the 2nd Ward of the City of Pittsburgh for public purpose to become part of the I-579 Cap Project.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Mobility and Infrastructure and/or the Director of the Department of Finance on behalf of the City of Pittsburgh are authorized to execute all relevant documents to accept a deed, in lieu of eminent domain, from the Sports & Exhibition Authority of Pittsburgh and Allegheny County to transfer certain property in the 2nd Ward of the City of Pittsburgh to become part of the I-579 Cap Project. Any applicable costs of closing of the property for this transfer from the Sports & Exhibition Authority of Pittsburgh and Allegheny County to the City of Pittsburgh, including recording fees, and transfer taxes, are to be borne by the Sports & Exhibition Authority of Pittsburgh and Allegheny County.
The property is described as follows: all or a portion of the same property conveyed or devised to the Sports & Exhibition Authority of Pittsburgh and Allegheny County by Public Auditorium Authority of Pittsburgh and Allegheny County, dated August 4, 2015 and recorded in Allegheny County Department of Real Estate at Deed Book 16076, page 82. This conveyance contains 0.093 acres/4.064 square feet and is identified in the plan attached as Exhibit A.
Section 2. The Mayor and the Director of the Department of Finance on behalf of the City of Pittsburgh are authorized to execute all relevant documents to acquire a temporary construction easement, in lieu of eminent domain, from the Sports & Exhibition Authority of Pittsburgh and Allegheny County on certain property in the 2nd Ward of the City of Pittsburgh identified in the plan attached as Exhibit B, to be used as part of the I-579 Cap Project. Any applicable costs of this acquisition including recording fees, and transfer taxes, are to be borne by the Sports & Exhibition Authority of Pittsburgh and Allegheny County.
