Resolution authorizing the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh (“City”), to enter into a License Agreement with the Pennsylvania Department of Transportation (“PennDOT”) to acquire the necessary air-space rights for construction of the I-579 Cap Project and thereafter for the operation of a public park to be dedicated after construction.

WHEREAS, the City wants to participate in the construction and obtain ownership of a cover over a depressed section of State Route (SR) 579 (a/k/a Interstate 579) between Centre Avenue and Bigelow Boulevard and open green space and certain other improvements over such cover and adjacent property (the “I-579 Cap Project”); and

 

WHEREAS, certain air-space is required for construction of the I-579 Cap Project and such airspace is currently under the jurisdiction of PennDOT; and  

 

WHEREAS, the City now wishes to enter into an agreement with PennDOT to license certain air-space to the City necessary for the construction of the I-579 Cap Project. 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1. The Mayor and Director of the Department of Mobility and Infrastructure, on behalf of the City, are now authorized to enter into an Agreement or Agreements with the Pennsylvania Department of Transportation in order to acquire a license of certain air-space required for construction of the I-579 Cap Project and thereafter for the operation of a public park to be dedicated after construction. A description of the licensed premises is attached hereto as Exhibit A.
