Ordinance amending the Pittsburgh Code, Title Six, Article I, “Regulated Rights and Actions,” Chapter 601, “Public Order,” by adding Section 601.20, “PROHIBITING NON-PERMITTED OCCUPANCY OF ROOFTOPS.”

WHEREAS, Pittsburgh Code, Title Six, Article I, “Regulated Rights and Actions,” Chapter 601, “Public Order” regulates behavior in the public and private realm within the borders of the City of Pittsburgh; and,

 

WHEREAS, it is the purpose of the government of the City of Pittsburgh to protect the safety of the citizens and residents of Pittsburgh; and,

 

WHEREAS, several incidents in recent years of individuals falling while sitting or standing on rooftops or roof overhangs not designed for habitation have resulted in serious or fatal bodily injury;

 

NOW, THEREFORE BE IT RESOLVED, that the Council of the City of Pittsburgh enacts as follows:

 

SECTION 1.                     The Code of the City of Pittsburgh is hereby amended so as to create and enact Chapter 601.20, which shall read as follows:

 

Chapter 601: - Public Order

 

§ 601.20 PROHIBITING NON-PERMITTED OCCUPANCY OF ROOFTOPS

 

(a) No person shall occupy or use the roof or roof overhang of a building when such roof is not designed and permitted for such occupancy by the City Building Code, except when performing repairs or maintenance of the roof or in an emergency situation, or where expressly permitted by a lease agreement.

 

(b) All other sections, parts and provisions of the Code of the City of Pittsburgh shall remain in full force and effect as previously enacted and amended.
