Title: Ordinance to vacate a pedestrian pathway known as "Chatham Lane," by partially repealing Ordinance 19 of 1964 (filed in City of Pittsburgh Ordinance Book 68, Page 460) entitled "an Ordinance accepting the dedication of Chatham Lane, 15 feet wide between Chatham Street and Bigelow Boulevard and the underpass below Webster Avenue as shown and describe in Pennsylvania Department of Highways' drawing for construction of Route No. 1026, Section No. 2/b, pages 19 and 23, for pedestrian ramp, opening and naming the same; also accepting the dedication of four (4) open areas adjacent to the Crosstown Boulevard as shown and dedicated in Urban Redevelopment Authority Plan Drawing 256-P-7 and 256-P-8, and providing certain terms and conditions; all in the Second Ward of the City of Pittsburgh."

WHEREAS, pursuant to Ordinance 19 of 1964 the City accepted the dedication of certain parcels of property adjacent to or near the Crosstown Boulevard, those parcels to be landscaped and not used for buildings or structures;

 

WHEREAS, also pursuant to that Ordinance 19 of 1964, the City accepted a pedestrian pathway it named Chatham Lane; and

 

WHEREAS, the parcels dedicated to City will be incorporated into the design of the I-579 Cap, a structure to provide a connection over the below-grade I-579 Crosstown Boulevard, thereby  re-establishing connectivity between the Hill District and the Downtown of Pittsburgh; and

 

WHEREAS, the surface design for the Cap is currently underway for creation of a 3 acre public open space with landscaping and convenient and assessable pedestrian and bicycle pathways; and

 

WHEREAS, the new design will supersede the existing pedestrian pathway provided by Chatham Lane, thus making the vacation of Chatham Lane advantageous for planning purposes;

 

The Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.  Sections 1, 2, 3, 4 and 5 of Ordinance 19 of 1964 are hereby repealed.

 

Section. 2.  Sections 6 and 7 of Ordinance 19 of 1964 are unchanged.

 

Section 3.   Any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, is hereby repealed so far as it affects this Ordinance.
