Resolution authorizing the Mayor and/or the Director of the Department of Finance, on behalf of the City of Pittsburgh, to execute a Declaration of Covenants to document the City’s responsibility to maintain certain storm-water management practices as required for an NPDES Permit in conjunction with a rehabilitation and improvement project for the Northeast Fountain and Promenade at Allegheny Commons.

WHEREAS, the City of Pittsburgh owns certain land containing +/- 6.415 acres, and being Allegheny County Tax ID 0008-B-00150 (“the Property”), commonly known as Allegheny Commons; and
WHEREAS, the Property is within the boundary of a Pennsylvania National Pollutant Discharge Elimination System (“NPDES”) Permit for Discharges Associated with Construction Activity (PAG-02000216019);
WHEREAS, as part of the requirements for the NPDES permit, the City of Pittsburgh must execute a Declaration of Covenants to protect certain storm-water management practices located on the Property;
WHEREAS, the Council of the City of Pittsburgh believes that the best interest of the City of Pittsburgh will be served by filing a Declaration of Restrictions and Covenants which run with the Property, and desires to give its approval.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and/or the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute a Declaration of Covenants to document the City’s responsibility to maintain certain storm-water management practices in Allegheny Commons. The form and substance of the Declaration of Covenants shall be approved by the City Solicitor.
