Title: Resolution amending City of Pittsburgh Council Resolution No. 633 of 2002 and providing for the establishment of a Mellon Park Tennis Trust Fund for the purpose of holding in trust all monies collected from the Mellon Park Seasonal Support Structure. The purpose of this amendment is to expand the permitted uses of funds from said Trust fund and to eliminate obsolete provisions regarding previous payments of lease amortization costs.

Title

Resolution amending City of Pittsburgh Council Resolution No. 633 of 2002 and providing for the establishment of a Mellon Park Tennis Trust Fund for the purpose of holding in trust all monies collected from the Mellon Park Seasonal Support Structure. The purpose of this amendment is to expand the permitted uses of funds from said Trust fund and to eliminate obsolete provisions regarding previous payments of lease amortization costs.

 

Body

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor, the Controller, the Director of Parks and Recreation (“Citiparks”) and the Treasurer of the City of Pittsburgh are authorized, on behalf of the City of Pittsburgh, to establish the Mellon Park and Indoor Tennis Trust Fund.

 

Section 2.  Such Mellon Park and Indoor Tennis Trust Fund shall hold all monies received from the income of revenues from the Mellon Park Seasonal Support Structure and other indoor tennis facilities to supplement the payment of various administrative and operational costs in connection improvements to the Mellon Park, Citiparks’ indoor tennis program and/or other Citiparks indoor tennis facilities.

 

Section 3. Only the Department of Parks and Recreation and no other City department is permitted to draw upon the Mellon Park and Indoor Tennis Trust Fund for any uses whatsoever.

 

Section 4.  The Department of Parks and Recreation shall at all times set aside reserve funding within this trust to provide for the replacement or repair of any and all existing indoor facilities within two years of construction or replacement. 

 

Finally, that any Ordinance or Resolution or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
