WHEREAS, the City is the owner in fee of certain real property in Schenley Park in Pittsburgh Pennsylvania; and

WHEREAS, The Pittsburgh Parks Conservancy ("PPC") and the City have entered into a Cooperation Agreement whereby the PPC has agreed to provide co-stewardship and planning assistance to the City, and is currently working with area foundations, corporate and government sources for funding to restore and improve the natural habitat, create recreational opportunities and improve public enjoyment of certain City properties including the Property; and

WHEREAS, the Pittsburgh Water and Sewer Authority ("PWSA") Authority has established a Green Infrastructure Matching Grant Program (the "Grant Program") to provide financial assistance to certain qualified entities; and

WHEREAS, one objective of the Grant Program is to increase the use of green infrastructure in the City of Pittsburgh and reduce stormwater runoff that would otherwise have been discharged to PWSA's wastewater and stormwater system in order to improve and enhance water quality resources downstream; and

WHEREAS, another objective of the Grant Program is to increase public awareness of green infrastructure techniques for stormwater management using signage and/or educational programs; and

WHEREAS, the PPC applied for and was awarded a grant under the Grant Program to design, construct, and install a green infrastructure project known as the Westinghouse Memorial Pond Restoration (the "GI Project") in the Park; and
