Resolution vacating portions of Guckert Way, Turtle Way, and 5 Foot Unnamed Way in the 23rd Ward, 1st Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of port ions of Guckert Way, Turtle Way and 5 Foot Unnamed Way in the 23rd Ward, 1st Council District of the City of Pittsburgh have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation, therefore vacating:
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
1. Guckert Way, ten feet (10') wide from previously vacated portion of Guckert Way per Vacation Ordinance No. 107 of 1962; extending approximately three hundred fifty feet (350') Eastward to the bend in Guckert Way which is twenty (20") feet wide that continues approximately ninety five feet (95') to Phineas Street for a total of five thousand four hundred (5,400) square feet of area.
2. Turtle Way, ten feet (10') wide between Phineas Street and Guckert Way for a distance of ninety five feet (95') ?
3. Five foot (5') Unnamed Way between Phineas Street and Guckert Way, adjacent to Allegheny County Lot and Blocks 24-N-53 and 24-N-54.
4. The 15" sewerline located therein can be abandoned per PWSA Rules & Specifications; in the 23rd Ward, 1st Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however shall not take effect or be of any force or validity unless owners of all the property fronting or abutting portions of Guckert Way, Turtle Way and 5 Foot Unnamed Way ...
