Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Public Works are hereby authorized

to enter into an Ownership and Maintenance Agreement with the Nine Mile Run

Watershed Association (NMRWA) and Pittsburgh Water and Sewer Authority (PWSA)

for Green Infrastructure improvements in the Oakwood Avenue & Batavia Street

public right-of-way situated in the 13th Ward of the City of Pittsburgh.

 

Section 2.                     At their own expense, the NMRWA will furnish and install new Green Infrastructure

in the Oakwood Avenue & Batavia Street public right-of-way, and will permit the CITY to participate

in the final inspection and to receive complete As-Built Plans.

 

Section 3.                     At their own expense, the NMRWA will maintain the new Green Infrastructure system

for three years.

 

Section 4.                     After three years of maintenance and repair of the Green Infrastructure

improvements to the satisfaction of the CITY installed in the Oakwood Avenue & Batavia Street

public right-of-way, the CITY and PWSA will assume maintenance and repair of their

respective new green infrastructure features.   

 

Section 5.                     The form and substance of the Ownership and Maintenance Agreement will be

subject to the approval of the City Solicitor.
