Body
WHEREAS,
in Pittsburgh approximately 1,000
individuals are charged annually with possess
ing a "small amount" of
marijuana, def
ined as 30 grams or less of
marijuana possessed for personal use. Police officers are required to appear for a Court hear
ing
in every case where possession of a "small amount" is charged; and
WHEREAS, the City of Pittsburgh Police Department and the Office of the District Attorney of Allegheny County have regularly and rout
inely reduced all "small amount"/m
inor
marijuana possession charges to a summary offense with the payment of a f
ine; and
WHEREAS, merely be
ing charged with a controlled substances violation can result
in the loss of employment and hous
ing opportunities, especially
public hous
ing opportunities; and
WHEREAS, a grow
ing number of States and Cities have recently passed laws as it perta
ins to the decrim
inalization of small amounts of
marijuana possessed for non-medical personal use.
In 2012 the City of Chicago moved to decrim
inalize small amounts allow
ing police to issue tickets
instead of mak
ing an arrest.
In 2014 Wash
ington D.C. passed a similar ord
inance provid
ing for a $25.00 f
ine for possession of a small amount; and
WHEREAS, the expungement procedure is lengthy and f
inancially burdensome. Failure to properly expunge a cannabis possessory offense will result
in said offense rema
ining on a person's crim
inal history despite the charge hav
ing been resolved as a summary offense; and
WHEREAS, racial m
inorities
in the City of Pittsburgh, predom
inantly black males, are charged with m
inor possessory offenses five times more often than their white colleagues despite similar rates of usage; and
