Title

Resolution authorizing a five-year Intergovernmental Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh and the Housing Authority of the City of Pittsburgh utilizing the City of Pittsburgh as the responsible entity pursuant to the National Environmental Policy Act of 1969 (“NEPA”) to assume the responsibility of HUD for environmental reviews and for making decisions and taking actions that include executing the certification portion of HUD's Request for Release of Funds and Certification for the subject Authorities public housing grant program. (Council Districts:  All).

 

Body

WHEREAS, the URA is a body, public and corporate, authorized under state law to undertake projects and/or activities for redevelopment, housing, community and economic development; and

 

WHEREAS, the HACP is a public housing authority authorized under state law to undertake projects and/or activities for public housing development with federal financial assistance; and

 

WHEREAS, such projects and activities receiving federal financial assistance are subject to the policies of the National Environmental Policy Act of 1969 (“NEPA”) and implementing regulations of the Council on Environmental Quality, including but not limited to the regulations at 40 CFR Parts 1500-1508, and implementing regulations of the U.S. Department of Housing and Urban Development (“HUD”), including but not limited to HUD’s regulations at 24 CFR Parts 50 and Part 58; and

 

WHEREAS, pursuant to 24 CFR §58.2(a)(7)(ii)(B), where the recipient of federal financial assistance is an urban redevelopment authority, a public housing agency, and/or a unit of general local government where the project is located, is authorized to assume environmental review obligations as the Responsible Entity; and

 

WHEREAS, the City certifies that it is required to: (1) assume the responsibility of HUD as the Federal decision making entity under NEPA and each provision of law designated in the NEPA related laws in 24 CFR Part 58.5, and to accept jurisdiction of the Federal courts for enforcement of the environmental responsibilities applicable to any and all of the HUD assistance awarded to Authority; and (2) assume HUD’s responsibility for environmental reviews, decision making and actions including executing the certification portion of HUD’s Request for Release of Funds and Certification for the subject Authority public housing grant program as set forth in 24 CFR Part 58.2(a)(7)(ii)(B); and

 

WHEREAS, for the purpose of conducting project development, the URA and HACP utilize the City as the Responsible Entity with respect to the URA’s and HACP’s projects for which environmental review and decision-making is required; and

 

WHEREAS, upon the conditions and provisions set forth in this Agreement, City is required to so act as the Responsible Entity with respect to said projects.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Director of the Department of City Planning, on behalf of the City of Pittsburgh, are hereby authorized to enter into a five-year Intergovernmental Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh and the Housing Authority of the City of Pittsburgh utilizing the City as the Responsible Entity pursuant to the National Environmental Policy Act of 1969 (“NEPA”) to assume the responsibility of HUD for environmental reviews and for making decisions and taking actions that include executing the certification portion of HUD's Request for Release of Funds and Certification for the subject Authorities public housing grant program as set forth in 24 CFR Parts 50 and 58, 40 CFR Parts 1500-1508, and Section 102 of the National environmental Policy Act of 1969 (NEPA).
