Title

Resolution authorizing the Mayor, the Pennsylvania Department of Transportation, and the City of Pittsburgh Department of Public Works to enter into an agreement with the Pittsburgh Parking Authority of Allegheny County, for the City of Pittsburgh and the Pennsylvania Department of Transportation to enter land owned by the Pittsburgh Parking Authority to construct, own and maintain the Liberty Bridge Rain Garden.

 

Body

WHEREAS, the Pennsylvania Department of Transportation (PennDOT) has an aerial easement and owns the Liberty Bridge; and

 

WHEREAS, PennDOT and its agents desire to reconstruct portions of the Liberty Bridge including the Liberty Bridge Rain Garden (LBRG); and

 

WHEREAS, the Pittsburgh Parking Authority (PPA) desires to grant a license to PennDOT and its agents and the City of Pittsburgh (City) to construct, own and maintain the new LBRG; and

 

WHEREAS, PennDOT and the City agree to jointly maintain the LBRG; and

 

WHEREAS, the City now wishes to formally enter into an agreement with PennDOT to maintain the LBRG.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

 

Section 1.         The Mayor and, the Director of the Department of Public Works are authorized to enter into a license and maintenance agreement(s) with PPA and PennDOT to operate, maintain and construct the LBRG.
