Title

Resolution authorizing the Mayor and the Director of the Department of Innovation & Performance to enter into 1) a Cooperation and Project Agreement or Agreements with the University of Pittsburgh and Allegheny County and 2) a Data Sharing Agreement or Agreements with the University of Pittsburgh or a Joint Data Sharing Agreement or Agreements with the University of Pittsburgh and Allegheny County pertaining to the creation and operation of a web-based open data portal to be named the Regional Data Center and further authorizing the Director of Innovation & Performance to execute one or more Data Deposit and/or Data User Agreements if required to facilitate the City’s contribution to and use of the Regional Data Center.

 

Body

WHEREAS, the City, Allegheny County (the “County”), and the University of Pittsburgh (the “University”) have a joint goal of working together to make the provision of public services better, faster, and more equitable in our region; and

 

WHEREAS, in support of this important goal, the City and the County applied for a grant from the Richard King Mellon Foundation (“RK Mellon”) to fund a number of important information infrastructure-based initiatives including: 1) recruiting data experts to work directly for both government entities in separate “Government Solutions Engineering Groups” in order to encourage modernization and to develop data-driven management tools for leadership and 2) developing a Regional Data Center (“RDC”)  to serve as a central open data portal able to host data from the Government Parties and eventually from other participating local governments and other eligible entities (collectively, the “Initiatives”);  and

 

WHEREAS, RK Mellon has generously awarded the City funding through a grant of $400,000 made directly to the City, which the City has used or will use to fund the Code of America Fellowship Participation as well as components of the Regional Data Center; and

 

WHEREAS, RK Mellon has also generously awarded a separate grant to the County, which includes funding to be used on behalf of both the City and the County in support of the creation of the RDC; and

 

WHEREAS, the grant made to the County specifically contemplates that the City and the County will enter into an agreement with University under which University will work to develop and operate the RDC for the City and the County over a three (3)-year period (the “Project”); and

 

WHEREAS, in 2014, City Council approved the addition of Chapter 162 to the City Code, which, inter alia, addressed the creation of an open data portal through which members of the public can easily access designated City data; and

 

WHEREAS, in furtherance of this important policy, the City plans to contribute  designated City data to the RDC and may, in the future, also wish to use RDC data provided by others for government purposes.                      

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Mayor and the Director of the Department of Innovation & Performance are authorized to enter into: 1) a Cooperation and Project Agreement or Agreements with the University of Pittsburgh and Allegheny County and 2) a Data Sharing Agreement or Agreements with the University of Pittsburgh or a Joint Data Sharing Agreement or Agreements with the University of Pittsburgh and Allegheny County pertaining to the creation and operation of a web-based open data portal to be named the Regional Data Center.  All payments to the University for work performed under the Cooperation and Project Agreement will be made by the County through grant funds awarded by RK Mellon on behalf of the City and County.  

 

Section 2.

 

In order to facilitate the transfer, use, and licensing of City data contributed to the Regional Data Center, the Director of Innovation & Performance is further authorized to execute one or more Data Deposit and/or Data User Agreements as may be required by the terms of use of the proposed Regional Data Center.

 

Section 3. 

 

The terms of all Agreements authorized hereunder are subject to the review and approval of the City Solicitor as to form and substance.
