Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a Cooperation and License Agreement with the University of Pittsburgh to implement concurrent construction projects for driveway renovations and related site improvements in Riverview Park and the adjacent Allegheny Observatory.

Body
WHEREAS, University is the owner of the Allegheny Observatory, which is situated on a two (2) acre rectangular parcel and surrounded by the City's Riverview Park in Pittsburgh, Pennsylvania; and

WHEREAS, the City desires to undertake driveway renovations and related site improvements to its Riverview Park Property; and

WHEREAS, the University similarly desires to undertake driveway renovations and related site improvements to its Allegheny Observatory Property; and

WHEREAS, in order to potentially benefit from certain economies of scale and efficiencies and to better facilitate the improvements each desire to undertake, the City and the University intend to cooperate in jointly bidding out their site improvement work (the "Project"); and

WHEREAS, although the City will issue one Invitation for Bids/Bid Package on behalf of both parties for the Project Work, each will thereafter independently review bids for their respective Site Improvements and separately determine whether to accept bids and enter into contracts with the selected contractor(s) according to applicable law and each party's required procurement processes; and

WHEREAS, in order to enable the parties, their same landscape architect, and any selected contractor(s) to administer and conduct the Site Improvements and perform the Project Work to be done on both City Property and the University Property, both parties need to authorize each other and each other's contractor(s) and agents to have access to and to operate on the other's property; and
