Resolution vacating Antler Way between South Highland Avenue and Sheridan Square in the 8th Ward, 9th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on Antler Way in the 8th Ward, 9th Council District of the City of Pittsburgh, have petitioned the council of the City Of Pittsburgh to enact a resolution for the vacation of same, and
 
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.        ALL that certain parcel of land being a portion of Antler Way, a variable width public right of way; Said right of way being situate in the 8th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania and being more particularly described as follows is hereby vacated:
 
BEGINNING at a point at the northeasterly corner of the intersection of Penn Avenue, a 100 foot public right of way, and South Highland Avenue, a 60 foot public right of way; Said point also being the northwesterly corner of Lot 1 in the Levi Wilsons Plan of Lots as recorded in Plan Book Volume 5, page 140 in the office of the Allegheny County Department of Real Estate; Thence along the easterly line of South Highland Avenue the following course and distance; South 7 degrees 49 minutes 11 seconds West, 106.07 feet to the true point of beginning; Said point also being the northeasterly corner of the intersection of South Highland Avenue and Antler Way, a variable width public right of way and the southwesterly corner of said Lot 1 in said Levi Wilsons Plan; Thence along the northerly line of Antler Way the following course and distance, South 63 degrees 41 minutes 49 seconds East, 208.86 feet to a point on the northwesterly corner of the intersection of Sheridan Square, a variable width public right of way and Antler Way and the southeasterly corner of said Lot 10 in said Levi Wilsons Plan; Thence through Antler Way and along the westerly line of Sheridan Square the following coarse and distance; South 26 degrees 22 minutes 24 seconds West, 23.00 feet to a point on the southerly line of Antler Way and Lot 1 in the South Highland Avenue Plan of Lots as recorded in Plan Book Volume 273, page 143 in the office of the Allegheny County Department of Real Estate; Thence along the southerly line of Antler Way and said Lot 1 in the South Highland Avenue Plan of Lots the following course and distance; North 63 degrees 41 minutes 49 seconds West, 100.06 feet to a point on the dividing line of Lot 1 in said South Highland Avenue Plan of Lots and lands now or formerly Highland Wallace L.P.; Said point also being on the westerly line of Antler way; Thence along the westerly line of Antler Way and the easterly line of said lands of Highland Wallace L.P. the following course and distance, North 26 degrees 22 minutes 11 seconds, 3.00 feet to a point on the southerly line of Antler Way and the northeasterly corner of said lands of Highland Wallace L.P.; Thence along the southerly line of Antler Way and said land of Highland Wallace L.P. the following course and distance, North 63 degrees 41 minutes 49 seconds West, 102.09 feet to a point being the southeasterly corner of said intersection of South Highland Avenue and Antler Way; Thence through Antler Way and along the easterly line of South Highlands Avenue the following coarse and distance, North 7°49'11" East, 21.09 feet to the true point of beginning.
 
Containing 4,410 square feet or 0.1012 acres, more or less, and also reserving the right of easement of a fifteen inch (15") sewer line and a eight inch (8") water line located therein, in the 8th Ward, 9th Council District of the City of Pittsburgh as described below shall be and the same is hereby vacated.
 
Section 2.      This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Antler Way as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh, the same of $51,420.00 use of the City of Pittsburgh.
