TITLE

Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a Municipal Pole Installation and Maintenance Agreement or Agreements with the Extenet Systems, Inc. ("Extenet") to construct and maintain distributed antenna systems ("DAS") in the City of Pittsburgh public right of way.

WHEREAS, pursuant to the Pittsburgh City Code Title IV, Public Places and Property, Article II, Telecommunications, Chapter 427, Telecommunications Systems in the Public Rights-of-Way, Extenet, a distributed network infrastructure company, has applied for a telecommunications license to construct and maintain distributed antenna systems in the public right of way; and

WHEREAS, in order to construct the distributed antenna systems, Extenet has proposed to remove certain City street light poles and replace them with new street light poles that accommodate a DAS in the base of each light pole; and

WHEREAS, the City now seeks to enter into a Municipal Pole Installation and Maintenance Agreement with Extenet to set forth terms relating to the installation and maintenance of DAS street light poles; and

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a Municipal Pole Installation and Maintenance Agreement with Extenet to replace and maintain 11 locations and in a distributed antenna system in the City's public right of way as detailed in Exhibit A. The Municipal Pole Installation and Maintenance Agreement shall be approved by the City Solicitor as to form and substance.
