Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. That Concord Sierra, D.A. Shadyside, LP, 11410 Common Oaks Drive, Raleigh, NC, 27614, their successors and assigns, are hereby granted the privilege to construct, maintain and use at their own cost and expense, a raised landscape planter with a maximum width of five feet (5'), approximately two-hundred twenty one feet (221') in length along the north sidewalk area of Baum Boulevard between South Atlantic Avenue and South Aiken Avenue. The raised planter will consist of a six inch (6”) high by six inch (6”) wide concrete curbing and a variety of landscape plantings; per BTE Project No. 14001, and easement agreement Resolution No. 782, effective December 18, 2013. A minimum six foot (6') sidewalk width to be open for pedestrian access in the 8th Ward, 8 Council District of the City of Pittsburgh.

The said encroachment shall conform to the provisions of their resolution and in accordance with the Plan identified as Accession D-791 on file in the Division of Surveys, Department of Public Works.

Section 2. The said Grantee prior to the beginning of the construction of said encroachment shall submit to the Director of the Department of Public Works of the City of Pittsburgh a complete set of plans, in triplicate, showing the location and all details of said construction. Said plans and said construction shall be subject to the approval and supervision of the Director of the Department of Public Works.
