Title

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.   The Pittsburgh Code is hereby amended at Title 4 - Public Places and Property, Article I, Public Rights -of -Way, CHAPTER 416: - OBSTRUCTIONS, by adding a new section at 416.05 (a) et seq. requiring no less than a ten (10) day notice of a pending major street obstruction permit to be provided to the City Council; written notice to businesses and or residents within the impacted area; and providing for a waiver of said requirements in the event of an emergency.
ยง 416.05 - STANDARDS OF PERMIT ISSUANCE.
The Director of Public Works shall not issue any permit when the work involved will unnecessarily interfere with the flow of traffic, cause a dangerous traffic condition, not be suitable location for the type of construction for which the permit is sought, or would be detrimental to the health, welfare or safety of City residents.
(a)      No less than than (10) days after receipt of an application for a Major Street Obstruction ("MSO") permit, the Director of the Department of Public Works or, the Director's designee, shall provide written notice to the Council of the City of Pittsburgh, by way of the City Clerk, of the pending MSO permit application.
 
(b)      Notice to Council of a Major Street Obstruction permit shall provide:
(1) name and address of the permit applicant;
(2) location and purpose for the placement of the MSO;
(3) anticipated date of the placement of the MSO;
(4) term of the MSO Permit;
(5) a copy of the proposed traffic and access mitigation plan; and,
(6) a copy of written notice (see section 416.05(c)) sent to all businesses and/or residents in the impacted area.
(c)      Prior to issuance of a Major Street Obstruction permit, the Director of the Department of Public Works or the Director's designee, shall provide written notice to impacted residents and/or businesses of the pending Major Street Obstruction permit application. The notice shall provide:
1) name and address of the permit applicant;
(2) location and purpose for the placement of the MSO;
(3) anticipated date of the placement of the MSO;
(4) term of the MSO Permit;
(5) a copy of the proposed traffic and access mitigation plan; and,
(6) a date(s), time and place to meet with both city Public Works officials and the applicant to take public comment on the proposed impact/disruption mitigation plan(s). Said notice can be sent concurrently with the notice provided to Council.
(a) said public meeting notice shall provide, at a minimum, a thirty (30) day notice.  
(b) the 30-day meeting notice period begins from the date of the mailing.
 
(e) A Major Street Obstruction permit shall not be issued by the Department of Public Works until said public comment and informational meeting(s) are held and all reasonable measures are taken to mitigate the foreseeable adverse impact(s).
 
(f) In the event of an emergency, as determined by the Department of Public Safety, the ten (10) day written notice to the Council and written notice to impacted businesses and/or residents is waived.
(1)      Written notice of the issuance an  MSO permit in response in an emergency, shall be provided to the Council by the Department of Public Works, accompanied by notification by the Director of Public Safety, describing the nature of the emergency, no less than forty-eight (48) hours after the issuance of the said permit.
