Title
Ordinance supplementing the Pittsburgh Code of Ordinances, Title One: Administrative, Article III: Organization, Chapter 139 Department of Parks and Recreation, by adding § 139.04. Swimming Pool Policies.
Body
Whereas, the City of Pittsburgh has long provided swimming pools and other water facilities for the recreation of the City's residents, and;
 
Whereas, the Department of Parks and Recreation ("CitiParks"), has a long-standing policy requiring youth groups who use City pools to provide their own lifeguards, and;
 
Whereas, the enforcement of this policy has begun to create an unfair burden to many of the organizations who provide summer programming which provides safe alternatives for children in many low- and moderate-income neighborhoods, and;
 
Whereas, an increasing number of violent crimes occur in the summer months when children are out of school and the temperatures rise substantially, and;
 
Whereas, the City has an obligation to staff its pools with lifeguards and other trained personnel to maintain the safety of the users, and;
 
Whereas, Council finds that eliminating this burden from youth groups and other community organizations is in the best interest of the City's children and is a public purpose.
 
 
Be it therefore resolved that the Council of the City of Pittsburgh does hereby enact as follows:
 
Section 1.  The Pittsburgh Code of Ordinances, Title One: Administrative, Article III: Organization, Chapter 139 Department of Parks and Recreation is hereby supplemented as follows:
 
§ 139.04. Swimming Pool Policies.
 
a.      During all hours of operation, the Director shall ensure that each City pool has the necessary number of lifeguards and other trained personnel to ensure the safety of all persons using said pools.
 
b.      The Director is hereby authorized and directed to coordinate with youth groups and other organizations wishing to use City pools to ensure that the maximum capacity of the pool facilities is not exceeded and to ensure availability of lifeguards and other necessary trained personnel.
 
c.      The Director is hereby authorized and directed to develop a policy for providing free and/or reduced swimming pool tags to low- and moderate-income youth who reside in the City and for organizations who provide summer programming for any City youth and to provide the Mayor and Council with a report detailing the necessary budgetary impacts.
 
d.      Group pool tags shall be allowed for individual use at during regular pool hours of operation.
 
Section 2.      This Ordinance shall take effect immediately upon passage.
