Title
Resolution authorizing the Mayor and/or the Director of the Department of Finance to execute a Declaration of Covenants to document the City's responsibility to maintain improvements to the Westinghouse Memorial Monument in Schenley Park and authorizing the Mayor and the Directors of the Departments of Public Works and Parks and Recreation to enter into a Project and License Agreement with the Pittsburgh Parks Conservancy to perform the restoration work for the Westinghouse Memorial and to provide a maintenance fund for its subsequent repair and conservation needs.  
 
Body
WHEREAS, the City is the owner of the Westinghouse Memorial in Schenley Park; and
 
WHEREAS, the Pittsburgh Parks Conservancy ("PPC") has received a grant from the Pennsylvania Historical and Museum Commission ("PHMC") in the amount of Twenty-Five Thousand Dollars ($25,000.00) for the repair and restoration of the Westinghouse Memorial (the Project"); and
 
WHEREAS, the PPC now desired to enter into a Project and License Agreement with the City to undertake the Project work; and
 
WHEREAS, the PHMC also requires property owners benefitting from its grants to execute a Declaration of Covenants agreeing to assume responsibility for the costs of maintenance, preservation, and administration of benefitted property for a period of fifteen (15) years; and
 
WHEREAS, in addition to its performance of the Project work, the PPC has agreed to establish a maintenance fund for the maintenance, preservation, and administration of the Westinghouse Memorial after the restoration has been completed to sync with the fifteen-year (15) term  requirements required in the Declaration of Covenants.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and/or the Director of the Department of Finance are hereby authorized to execute a Declaration of Covenants to document the City's responsibility to maintain planned improvements to the Westinghouse Memorial in Schenley Park. The Mayor and the Director of the Department of Public Works and the Department of Parks and Recreation are authorized to enter into a Project and License Agreement with the Pittsburgh Parks Conservancy to undertake the restoration of the Westinghouse Memorial and to establish a maintenance fund for the maintenance, preservation, and administration of the Westinghouse Memorial after the restoration has been completed to sync with the fifteen-year (15) term requirements required in the Declaration of Covenants. The form and substance of the Declaration of Covenants and the Project and License Agreement shall be approved by the City Solicitor.
