Title
Resolution authorizing the Mayor and the Director of the Department of Public Works and the Director of the Department of Finance to enter into a Trail License Agreement with the Pittsburgh Water and Sewer Authority and Friends of the Riverfront, Inc. for the construction and maintenance of a new public trail segment to be added to the Three Rivers Heritage Trail System.

Body
Whereas, the Friends of the Riverfront, Inc. “FOR” is a non-profit entity dedicated to reclaiming and restoring the Pittsburgh region's riverfronts for public use; and

Whereas, the City owns a parcel of property along the Allegheny River, a portion of which the Pittsburgh Water and Sewer Authority (“PWSA”) currently leases from the City as the location for a public water treatment facility; and

Whereas, with the financial assistance of Aspinwall Riverfront Park, Inc., FOR has offered to construct a new public trail segment (the “Trail) on the City's property and to thereafter perform designated maintenance thereon; and

Whereas, Resolution No. 80 of 2007, effective February 22, 2007, designates all existing and proposed non-park City of Pittsburgh riverfront trails, which includes the proposed Trail, to become part of the Three Rivers Heritage Trail System; and

Whereas, due to the location of the proposed Trail near the current PWSA water treatment facility, the City wishes to put the public on notice that dedication of this Trail to public use is being approved by City Council subject to the condition that a temporary or permanent closure and/or restriction on public access may be required in the future in the event of a threat to the health and safety of the public water supply and/or the integrity of the water facilities; and

Whereas, the parties now wish to enter into a Trail License Agreement to set forth the duties and responsibilities of the parties with respect to the construction and maintenance of the Trail.
