Title
Resolution authorizing the Mayor and the Directors of the Department of Parks and Recreation and the Department of Public Works to enter into a Project and License Agreement with the Pittsburgh Parks Conservancy in connection with capital improvements to and the use of office space and with the use of trailers in Frick Park for Frick Environmental Center programming.  
Body
WHEREAS, pursuant to Resolution No. 285 of 1998, effective May 29, 1998, the City entered into a Cooperation Agreement, dated April 10, 2000, with the Pittsburgh Parks Conservancy ("PPC") to establish an alliance to provide infrastructure improvements, special care, and restoration for the City's four regional parks: Frick, Schenley, Highland and Riverview and, where possible, to also assist in the capital and operational improvements for non-Regional neighborhood park areas; and
 
WHEREAS, pursuant to Resolution No. 364 of 2011, effective May 26, 2011, the City and the PPC agreed to extend the term of the Cooperation Agreement; and
 
WHEREAS, the PPC and the City pursuant to Resolution No. 572 of 2013, effective August 5, 2013, the City and the PPC entered into a separate Agreement dated December 17, 2013 pursuant to which the PPC will be assisting the City with the restoration of the Frick Environmental Center ("FEC") and will thereafter assist the City with the day-to-day operation and maintenance of the FEC; and  
 
WHEREAS, the PPC now desires to volunteer its services by providing capital improvements to office space located in the DPW facility at 1 English Lane in Frick Park and by using temporary trailers for shelter space, as needed at mutually agreed upon locations, for FEC educational programming space during the FEC restoration;  and
 
WHEREAS, the PPC is further seeking permission to use the improved office space and trailers while it assists with the provision of FEC educational programming during the restoration of the FEC.
 
WHEREAS, the PPC and City now wish to enter into a Project and License Agreement to define the scope of the services to be provided.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the Directors of the Department of Parks and Recreation and Public Works are hereby authorized to enter into a Project and License Agreement or Agreements with the PPC pursuant to which the PPC will provide capital improvements to temporary office space located in the DPW facility at 1 English Lane in Frick Park and to further provide for the use of such office space and  trailers for temporary shelter space at mutually agreed upon locations, as needed, for Frick Environmental Center programming while the Frick Environmental Center is undergoing restoration.  The form and substance of the Project and License Agreement(s) shall be subject to the approval of the City Solicitor.
