Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into an Easement and Maintenance Agreement with Ronald J. Kleppick to obtain an easement and right of way for the placement of City-owned fixtures on designated portions of the parcel located in the 10th Ward and identified in the Allegheny County Department of Real Estate as Lot and Block No. 120-J-164, commonly called 5700 Butler Street, City of Pittsburgh, Allegheny County, Pennsylvania, and for access for repair and maintenance for such fixtures.
Body
WHEREAS, Ronald J. Kleppick (“Grantor”) is the owner of certain property (Block and Lot 120-J-164) (the “Parcel”) situate in the 10th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, commonly called 5700 Butler Street; and

WHEREAS, in conjunction with final settlement with the City of civil actions in the Court of Common Pleas of Allegheny County denominated GD 09-015537 and GD 11-010771, Grantor has agreed to grant to the City a permanent easement and right of way (the “Easement”) for the placement of City-owned fixtures on designated portions of the Parcel and for access for repair and maintenance for such fixtures, and

WHEREAS, the parties now wish to enter into an Easement and Maintenance Agreement to document and set forth respective rights and duties relating to this grant.

Be it resolved by the Council of the City of Pittsburgh as follows:


Section 1. The Mayor and the Director of the Department of Public Works are authorized to enter into an Easement and Maintenance Agreement with Ronald J. Kleppick (“Grantor”) in which the Grantor will grant to the City an easement and right-of-way for the placement of City-owned fixtures on designated portions of the parcel located in the 10th Ward and identified in the Allegheny County Department of Real Estate as Lot and Block No. 120-J-164, commonly called 5700 Butler Street, City of Pittsburgh, Alleghen...
