Resolution authorizing the Mayor and the Acting Chief of the Bureau of Police to enter into an Agreement with the Borough of Wilkinsburg for the provision of police qualification services.
Body
Whereas, the Borough of Wilkinsburg (the "Borough") employs a police force for the protection of Borough residents and the enforcement of Borough laws; and, Whereas the Borough requires the services of an outside evaluator to administer occupational testing for a designated police officer in order to determine if this officer can perform the essential functions of the position in accordance with the Americans With Disabilities Act of 1990 (42 U.S.C. ยงยง 12101 et seq.); and
 
Whereas, the Borough has requested that the City's Bureau of Police (the "Bureau") perform the required services; and, Whereas the Bureau has agreed to provide this outside evaluation and the parties now wish to enter into an Agreement to set forth the terms and conditions of such engagement.          
 
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the Acting Chief of Police of the Bureau of Police are hereby authorized to enter into an agreement with the Borough of Wilkinsburg for the purpose of the Bureau providing police qualification testing services for a Borough police officer.  The qualification testing process may take place at the Bureau's firing range and/or training academy as may be required to perform the testing.  Fees for this service shall be set by the Bureau consistent with current rates for officer time, overtime and hearing/witness fees.  All fees received from the Borough shall be directed to the "Treasurer, City of Pittsburgh" and shall be deposited into account:
JDE 11101.51.51401.230000.2013.  The Agreement shall be approved by the City Solicitor as to form and substance.
