Title
Ordinance Directing the Allegheny County Board of Elections to place before the qualified voters of the City of Pittsburgh at the 2013 November General Election a referendum question "Shall the Pittsburgh Home Rule Charter, Article Seven, Personnel, be supplemented by adding Section 711 - Residency Requirements for All City Employees?"

Whereas, in 1974, the qualified voters of the City of Pittsburgh approved the adoption of a Home Rule Charter and thus the City became a home-rule municipality; and,

Whereas, the Home Rule Charter and Optional Plans Law, 53 Pa.C.S.A. § 2961, et seq., is a broad grant of municipal authority to the City of Pittsburgh; and,

Whereas, seventy-one percent (71%) of the City's annual budget is allocated to wages and benefits for City Employees, amounting to $334 million dollars in 2013; and,

Whereas, the City has the legal authority to prescribe eligibility requirements of City employees; and,

Whereas, the Act for Cities of the Second Class, 53 P.S. § 23532, as amended by the Act of 2012, Oct. 24, P.L. 1605, No. 195, § 1, grants to the City the right to prescribe eligibility requirements for all of its employees, should it so choose; and,

Whereas, the residents of the City of Pittsburgh have the right, under the Home Rule Charter and Optional Plans Law, via petition and initiative, to amend or supplement the Charter; and,

Whereas, City Council has received a demand from residents to place this question on the ballot in the November 2013 General Election.

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Allegheny County Board of Elections is hereby directed to place before the qualified voters of the City of Pittsburgh a referendum question at the 2013 November General Election: Shall the Pittsburgh Home Rule Charter, Article Seven, Personnel, be supplemented by adding Section 711 - Residency Requirements for All City Employees:
