Title
Resolution providing for an Agility Agreement between the Department of Public Works, City of Pittsburgh, and the Department of Transportation, Commonwealth of Pennsylvania, to allow for the trading of maintenance functions between the respective agencies.
Body
The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized and directed to enter into an Agility Agreement with the Department of Transportation, Commonwealth of Pennsylvania, for the purpose of trading maintenance functions. Said agreements shall be in a form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City as said Solicitor may require.

1) This agreement is made and entered between the Commonwealth of Pennsylvania, acting through the Department of Transportation, hereinafter called Commonwealth and the following political subdivision of the Commonwealth of Pennsylvania, acting through its authorized officials, hereinafter called the MUNICIPALITY, City of Pittsburgh, Allegheny County, Federal ID #256000879.

2) NOW, THEREFORE, the parties hereto, for and in consideration of the information contained in Attachment A, attached hereto and made part hereof, with the intention of being legally bound, hereby agree to trade maintenance functions as a partner in an Agility Agreement (A).

Modifications to the activities listed in this agreement may be incorporated at any time during the life of the agreement through the execution of an Agility Agreement Amendment signed by authorized agents for both parties involved.

3) This agreement shall be effective for five (5) years, unless terminated sooner for cause upon thirty (30) days' written notice by either party to the other, at which time all obligations shall cease.
