Resolution amending Resolution No. 729, approved December 5, 2006, effective December 7, 2006, entitled "Providing for an Agreement or Agreements, or for the use of existing Agreements, with a Consultant or Consultants, for design services in connection with the reconstruction of Penn Avenue from 34th Street to Negley Avenue, including Project Management Services; providing for a Reimbursement Agreement or Agreements with the Commonwealth of Pennsylvania; and further providing for the payment of the costs thereof., at a cost not to exceed $2,140,000.00," by adding language.

The Council of the City of Pittsburgh hereby enacts as follows:
Section 1 of Resolution No. 729, approved December 5, 2006, effective December 7, 2006, which presently reads as follows:
"The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into an Agreement or Agreements, or to use existing Agreements, in form approved by the City Solicitor, with a Consultant or Consultants, for engineering services related to the design for the reconstruction of Penn Avenue from 34th Street to Negley Avenue, at a cost not to exceed $2,140,000.00, chargeable to and payable from the following accounts:

The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Contract or Contracts or the use of existing Contracts; an Agreement or Agreements or the use of existing Agreements; providing for repairs, maintenance, improvements, emergencies and/or the purchase of materials, equipment and supplies in connection with the reconstruction of Penn Avenue from 34th Street to Negley Avenue, at a cost not to exceed $2,140,000.00, chargeable to and payable from the following accounts:

Section 2. The Mayor and the Director of the Department Public Works, on behalf of the City of Pittsburgh, are herby authorized to enter into a Reimbursement Agreement with the Commonwealth of Pennsylvania, Department of Transportation, for reimbursement of the governments' share of costs to the City.
Section 3. In all other respects, Resolution No. 729, approved December 5, 2006, effective December 7, 2006, remains unchanged and in full force and effect.
