Resolution vacating Putnam Street (aka Aurelia), Leggett Way, Festival Street (aka Kaufman Street) and Festival Street in the 7th, Ward, 8th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Putnam Street (aka Aurelia), Leggett Way, Festival Street (aka Kaufman Street) and Festival Street in the 7th Ward, 8th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That vacating Putnam Street (aka Aurelia), Leggett Way, Festival Street (aka Kaufman Street) and Festival Street.
1. Aurelia Street, 40.02 feet wide, a functioning street, from Putnam Street Northwest to its terminus a distance of 161.03 feet containing 6,449 square feet of area.
2. Leggett Way, average 30.33 feet wide, a variable width, a functioning street from Aurelia Street Southwest to Kaufman Street a distance of 105 feet containing 3,185 square feet of area.
3. Kaufman Street, 15 feet wide, a functioning street, from Leggett Way Northwest to its terminus a distance of 192 feet containing 2,880 square feet of area.
4. Festival Street, 20.02 feet wide, paper or unopened from Kaufman Street Southwest to its terminus at Social Way, a distance of 296 feet containing 5,928 square feet of area.
The Total area of these vacations is 18,440 square feet of area.
There are 6" waterlines and a PWSA fire hydrant within the area of the proposed vacation. The existing waterline in the proposed vacated area can be abandoned if the abutting properties are to be demolished and/or removed. The said 6" waterlines can be abandoned if a Tap Termination Plan and Private Water and Sewer Construction Plans are filed according to PWSA current regulations. The existing tees, valves, fire hydrant and appurtenances must also be removed and/or relocated as per current Regulations and current PWSA/Developer Agreement(s). Therein, in the 7th Ward, 8th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Putnam Street (aka Aurelia), Leggett Way, Festival Street (aka Kaufman Street) and Festival Street as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $62,570.00 use of the City of Pittsburgh.
