Resolution requesting the approval of an inter-municipal transfer of restaurant liquor license, License No. R-9960, from Chick's Grill, LLC, 3711 Walnut Street, McKeesport, PA 15132 to Applicant Ratthasak Insawang Nicky's Thai Kitchen III, Inc., 1631 Allegheny Avenue, Pittsburgh PA 15233; into the premises to be known as Nicky's Thai Kitchen III, Inc., 903 Penn Avenue, Pittsburgh, PA 15222, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-9960, from Chick's Grill, LLC, 3711 Walnut Street, McKeesport, PA 15132 to Applicant Ratthasak Insawang Nicky's Thai Kitchen III, Inc., 1631 Allegheny Avenue, Pittsburgh PA 15233; into the premises to be known as Nicky's Thai Kitchen III, Inc., 903 Penn Avenue, Pittsburgh, PA 15222 pursuant to amended Pennsylvania Liquor Code, §4-461.
Section 2. Request for Approval
Applicant Ratthasak Insawang Nicky's Thai Kitchen III, Inc., -which has the mailing address of 1631 Allegheny Avenue, Pittsburgh PA 15233, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-9960, which is currently, registered to Chick's Grill, LLC, 3711 Walnut Street, McKeesport, PA 15132 desires to place restaurant liquor license into the premises known as Nicky's Thai Kitchen III, Inc., 903 Penn Avenue, Pittsburgh, PA 15222. The proposed interior of the premises is a restaurant business containing approximately 1,850 square feet of floor area.
Section 3. Public Hearing
City Council shall set a date for a Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning Nicky's Thai Kitchen III, Inc., 903 Penn Avenue, Pittsburgh, PA 15222, intent to the above liquor license.
Section 4. Approval or Denial of Request
After the Public Hearing which was held December 4, 2012, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove the request of Nicky's Thai Kitchen III, Inc., 903 Penn Avenue, Pittsburgh, PA 15222, for inter-municipal transfer of a restaurant liquor license. City Council must approve The Beer Market request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
