Resolution requesting the approval of an inter-municipal transfer of restaurant liquor license, License No. R-12937, from Nelson O. Lynch - 110 Congress, McKeesport, Pittsburgh, PA 15131 to Applicant 2031 Tortilla LLC - 2031 Penn Ave. Basement, Pittsburgh, PA  15222 into the premises to be known as Reyna's Tortilla Factory, pursuant to amended Pennsylvania Liquor Code, §4-461.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Council of the City of Pittsburgh hereby endorses the request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-12937, from Nelson O. Lynch - 110 Congress, McKeesport, PA  15131 to Applicant 2031 Tortilla LLC - 2031 Penn Ave. Basement, Pittsburgh, PA  15222 into the premises to be known as Reyna's Tortilla Factory, pursuant to amended Pennsylvania Liquor Code, §4-461.

Section 2.      Request for Approval

Applicant 2031 Tortilla LLC - which has the mailing address of 2031 Penn Ave. Basement, Pittsburgh, PA  15222, submitted a request for approval of an inter-municipal transfer of a restaurant liquor license, License No. R-12937, which is currently registered to Nelson O. Lynch. - 110 Congress, McKeesport, PA  15131 desires to place restaurant liquor license into the premises known as Reyna's Tortilla Factory - 2031 Penn Ave. Basement, Pittsburgh, PA  15222.  The proposed interior of the premises is a restaurant business containing 1,023 square feet and seats 67.

Section 3.      Public Hearing

City Council shall set a date for a Public Hearing for the purpose of receiving comments and recommendations of interested individuals residing in the City of Pittsburgh concerning  2031 Tortilla LLC, 2031 Penn Avenue, Pittsburgh, PA  15222, intent to the above liquor license.

Section 4.      Approval or Denial of Request

After the Public Hearing which was held October 24, 2012, and within 45 days of the introduction of this Resolution, City Council shall render a decision to approve or disapprove the request of 2031 Tortilla, LLC - 2031 Penn Ave. Basement Pittsburgh, PA  15222, for inter-municipal transfer of a restaurant liquor license.  City Council must approve the 2031 Tortilla LLC request unless it finds that approval would adversely affect the welfare, health, peace and morals of the City of Pittsburgh or its residents.
