Title
Resolution granting to Equitable Gas Company a permanent easement for installation of an above ground gas regulator on a portion of City of Pittsburgh property Parcel 19-G-131 in the 20th Ward.
Body
The Council of the City of Pittsburgh hereby enacts as follows:
 
Section 1.The Mayor and the Director of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement granting to Equitable Gas Company a permanent easement for location of a gas regulator on City of Pittsburgh parcel 19-G-131 fronting on Weaver Street in the 20th Ward.  Said agreement shall be on the form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of the City of Pittsburgh as the Solicitor may require.
 
The easement granted to Equitable Gas Company hereunder is further described on the legal description and survey attached respectively hereto as Exhibit A-1 and A-2.
 
Section 2      The privileges and easement herby granted shall be subject to the following terms and conditions as shall be more specifically set forth in the agreement authorized by this Resolution:
 
a)      Equitable Gas Company shall bear the full cost and expense of the installation, construction, use and maintenance of said easement.
b)      Equitable Gas Company shall indemnify, save harmless and defend the City of Pittsburgh from any and all damages or claims for damages, whether to property or to persons arising by reason of the construction, installation, maintenance, use or removal of the gas regulator.
c)      Equitable Gas Company shall pay the City the sum of One Thousand Dollar ($1,000.00) due on Date of the signing of the agreement authorized by this Resolution.
