Title
Resolution authorizing the Mayor and the Director of the Department of Public Works and the Department of Parks and Recreation to enter into a License, Loan, and Maintenance Agreement with the Carnegie Institute for Carnegie Museum of Art relating to the restoration, repair, reinstallation, loan and maintenance of sculptures for Allegheny Landing Park.

Body
WHEREAS, the City owns the public park now known as Allegheny Landing Park (the “Park”), which is located along the Allegheny River between the Roberto Clemente (6th Street) and Andy Warhol (7th Street) Bridges in the North Shore neighborhood of Pittsburgh; and

WHEREAS, certain sculptures known as Piazza Lavaro, Mythic Source, Pittsburgh Variations, and The Forks together with any base for each sculpture (collectively, the “Sculptures”) are located on the Property; and
WHEREAS, the Sculptures were originally commissioned and purchased by the Allegheny Conference for the enhancement and benefit of the Park and were subsequently donated to the Carnegie Museum of Art “CMA”; and
WHEREAS, in connection with the redesign and renovation of Allegheny Landing Park by Riverlife/Friends of Allegheny Landing, CMA intends to remove the Sculptures from their existing locations for the purpose of restoration and repair and to reinstall the Sculptures in certain locations for the enhancement and betterment of the Park; and
WHEREAS, the City desires to honor the historic placement of the Sculptures as originally commissioned and wishes to officially accept a loan of the Sculptures from the CMA for placement in the Park for the continued enjoyment of the public; and
WHEREAS, in connection with the restoration and replacement of the Sculptures in the Park, the City desires to enter into a License, Loan, and Maintenance Agreement or Agreements with the CMA to set forth the respective covenants, duties and responsibilities of the parties.
