Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into an easement agreement or agreements with THE SYCAMORE GRANDVIEW ASSOCIATES, LP, (“Sycamore”) a Pennsylvania limited partnership, and others whereby THE SYCAMORE GRANDVIEW ASSOCIATES, LP, and others grant to the City an easement along Wyoming Street, in the Nineteenth Ward of the City of Pittsburgh; for Wyoming Street is supported by a retaining wall (the “Wall”) for the construction over and across a portion of the Sycamore Property and a permanent easement for the Wall as it is constructed by the City.

Body
WHEREAS, the Sycamore is the owner of certain property, Block and Lot No. 4-C-70, situate in the 19th Ward, City of Pittsburgh, Allegheny County, Pennsylvania. The westerly boundary of the Sycamore Property abuts Wyoming Street, a public street in the City of Pittsburgh,

WHEREAS, the City is and will be responsible for the maintenance, repair and replacement of the Wall, and

WHEREAS, because of deterioration in the Wall's condition, City desires to reconstruct the Wall; and

WHEREAS, the Sycamore, is willing to grant to the City a temporary construction easement over and across a portion of the Sycamore Property and a permanent easement for the Wall as it is reconstructed by City.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Department of Public Works are authorized to enter into an easement agreement or agreements with the SYCAMORE GRANDVIEW ASSOCIATES, LP, (“Sycamore”) and others for the grant to the City of a temporary construction easement over and across a portion of the Sycamore Property and a permanent easement for the Wall as it is reconstructed by City, in the 19th Ward identified as Lot and Block No. 4-C-70, on Sycamore Street.
