Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a Coordination Agreement or Agreements with the Commonwealth of Pennsylvania, Department of Conservation and Natural Resources, for the purpose of setting forth defined cooperation pertaining to the operation and maintenance of Point State Park.
Body
Whereas, Point State Park (the "Park") is owned by the Commonwealth of Pennsylvania and is located within the boundaries of the City of Pittsburgh and administered by the Department of Conservation and Natural Resources ("DCNR"); and
Whereas, in 1984, the parties entered into a Maintenance and Use Agreement to cooperate in the operation and maintenance of the Park; and
Whereas, since that time, the parties' desired duties and responsibilities have changed; and
Whereas, the City and DCNR now wish to enter into a Coordination Agreement to update and document the current responsibilities of the parties with respect to the continuing joint operation and maintenance of Point State Park, including but not limited to maintenance duties of both parties, event management, and reimbursement to City for wages and benefits of affected personnel.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a Coordination Agreement or Agreements with the Commonwealth of Pennsylvania, Department of Conservation and Natural Resources for the purpose of setting forth defined cooperation pertaining to the operation and maintenance of Point State Park. The Coordination Agreement or Agreements shall be approved by the City Solicitor as to form and substance.
