Resolution accepting the dedication of Fern Street and Fern Circle, in the 10th Ward, 7th Council District.

WHEREAS, The Housing Authority of the City of Pittsburgh in the 10th Ward of the City of Pittsburgh, shown on the Garfield Heights Revision No. 4 Plan, has dedicated said, Fern Street and Fern Circle for public highway purposes.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That Fern Street and Fern Circle as laid out in the Garfield Heights Revision No. 4 Plan No. 5866, in the 10th Ward of the City of Pittsburgh are hereby accepted.
Section 2. The grading, paving, curbing, lighting and signage of Fern Street and Fern Circle as described: All that certain parcel of land, being Parcel 1-Revised in the Garfield Heights Revisions No. 4, as recorded in the Allegheny County Department of Real Estate, in Plan Book Volume 268, Page 80, situate in the 10th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the southwesterly right of way line of Mossfield Street, 63.00 feet wide, and the northerly right of way line of Fern Street, 50.00 feet wide; thence from said point of beginning by the southwesterly right of way line of Mossfield Street the following three (3) courses and distances: N 50° 20' 00" E a distance of 3.00 feet;
S 39° 40' 00" E a distance of 86.00 feet; S 50° 20' 00" W a distance of 3.00 feet to a point on the southerly right of way line of Fern Street; thence by the southerly right of way line of Fern Street the following seven (7) courses and distances: in a southwesterly direction by a curve bearing to the left having a radius of 18.00 feet through an arc distance of 28.27 feet to a point of tangency; S 50° 20' 00" W a distance of 81.89 feet to a point of curvature; in a northwesterly direction by a curve bearing to the right having a radius of 180.00 feet through an arc distance of 242.24 feet to a point of tangency; N 52° 33' 30" W a distance of 178.44 feet to a point of curvature; in a northwesterly direction by a curve bearing to the left having a radius of 675.00 feet through an arc distance of 138.43 feet to a point of tangency;
N 64° 18' 32" W a distance of 97.06 feet to a point of curvature; in an easterly direction by a curve bearing to the left having a radius of 825.00 feet through an arc distance of 498.80 feet to a point on the line dividing Parcel 1-Revise and Parcel B-R Third Revised in the Garfield Heights Revisions No. 4, as recorded in the Allegheny County Department of Real Estate, in Plan Book Volume 268, Page 80; thence by the line dividing Parcel 1-Revised and Parcel B-R Third Revised in said Garfield Heights Revisions No. 4, N 16° 18' 18" W a distance of 158.21 feet to a point; thence continuing by same in a northwesterly direction by a curve bearing to the left having a radius of 15.00 feet through an arc distance of 23.74 feet to a point on the southerly right of way line of Schenley Avenue, 50.00 feet wide at said point; thence by the southerly right of way line of Schenley Avenue N 73° 02' 00" E a distance of 139.98 feet to a point; thence continuing by same S 16° 58' 00" E a distance of 3.00 feet to a point on the northerly right of way line of said Fern Street; thence by the northerly right of way line of said Fern Street the following ten (10) courses and distances: in a southerly direction by a curve bearing to the left having a radius of 15.00 feet through an arc distance of 23.39 feet to a point of tangency; S 16° 18' 18" E a distance of 123.14 feet to a point of curvature; in an easterly direction by a curve bearing to the left having a radius of 5.00 feet through an arc distance of 6, 59 feet to a point of reverse curvature; in a southeasterly direction by a curve bearing to the right having a radius of 875.00 feet through an arc distance of 419.63 feet to a point of tangency; S 64° 18' 32" E a distance of 97.06 feet to a point of curvature; in a southeasterly direction by a curve bearing to the right having a radius of 725.00 feet through an arc distance of 148.69 feet to a point of tangency; S 52° 33' 30" E a distance of 178.44 feet to a point of curvature; in a northeasterly direction by a curve bearing to the left having a radius of 130.00 feet through an arc distance of 174.95 feet to a point of tangency; N 50° 20' 00" E a distance of 81.89 feet to a point of curvature; in a northeasterly direction by a curve bearing to the left having a radius of 18.00 feet through an arc distance of 28.27 feet to a point at the intersection of the southwesterly right of way line of said Mossfield Street and the northerly right of way line of said Fern Street, at the point of beginning, as per as built, drawings on file in the Department of Public Works; Containing an area of 77,383 square feet or 1.776 acres.
Resolution No. 228 of 2011 authorized the Mayor and the Director of the Department of Public Works to enter into a License and Maintenance Agreement with Garfield Heights, LLC ("GHLLC") to maintain a planting median strip on Fern Circle stretching from the intersection of Fern Circle and Fern Street to the south and Fern Circle and Schenley Avenue to the north. This agreement was made October 18, 2011.
Fern Street and Fern Circle are hereby accepted and declared to be public improvements of the City of Pittsburgh.
